“Website” means www.TotallyGifts.co.uk

“Customer” means who purchase(s) the vouchers from www.TotallyGifts.co.uk

“You or Your” means either the customer who purchases the voucher for himself or recipient who receives the voucher.

“Gifts” means the gift items or products listed on our website TotallyGifts.co.uk . Gift Items or products can be purchased directly from our website and can be sent to the recipient’s address.

“Experiences” means experiences purchased online and  can be redeemed on or before the voucher expiry date by the original purchaser or the recipient of voucher. Unless otherwise stated all vouchers are valid for 10 months from the date of purchase.

“Recipient” means the person who undertakes the Experience either purchaser or the person who receives the voucher.

“Supplier” mean third party supplier for the experience.

“Voucher” means the voucher issued by the company to the customer or someone else on behalf of the customer.

“The company” means Totally Gifts ltd.

“Price” means the cost of the gift or an experience voucher.

Vouchers
All vouchers purchased will be sent by the first class royal mail the delivery cost will be mentioned on the shopping cart page unless otherwise stated. You can request next day delivery for additional charges. Totally Gifts cannot be held liable for any loss incurred due to mail delays. All the vouchers that are not been originally issued by Totally Gifts or been tempered will be invalid and cannot be redeemed under any circumstances.
Keep your vouchers safely and securely. We do not accept any responsibility for any lost or stolen vouchers.

Delivery
The delivery of the experience vouchers delivered as stated on the website information pages.

All vouchers sent in a gift pack each voucher contains Unique Voucher Reference number to identify your voucher. The unique voucher reference no. should be quoted for all future correspondence with Totally Gifts.
If you lose your voucher please call us and we will be able to issue you another voucher for an additional £20 administration charges.
You must book your activity date before the expiry date of the voucher otherwise your voucher will be treated invalid after the expiry date printed on the voucher. You can extend your vouchers for an additional £20 extension charges.


Prices
We make every effort to display the correct price on our website and prices are reviewed on a regular basis. In the circumstances of the order is being placed of an incorrectly displayed experience or product we will contact the purchaser within 10 days from the purchase date. We will give customer an option of either cancelling the order or pay the difference in the price.

Availability
Some of the experiences are busy in the peak season so please book in advance to avoid any disappointment. Totally Gifts sells open dated vouchers and recipients are free to book their preferred date and location subject to availability and subject to weather conditions on the experience day.

Weather
The event can be cancelled due to the weather. In any circumstances no refund will be issued for any postpone or cancellation by the supplier. Totally Gifts will not be held responsible for any cancellation if supplier have to cancel the event due to the reasons beyond his control. The Recipient should contact the Supplier prior to departure to check the likelihood of cancellation due to weather. We strongly recommend to contact the supplier before well in advance to check the weather conditions on your experience day.

Suppliers
Although Totally Gifts has carefully selected all the experience suppliers Totally Gifts Ltd shall not be responsible for safety standards or the quality or delivery of the experience, or any loss or damage incurred by you whilst participating in the experience for which the supplier shall be solely responsible.
By purchasing or redeeming a Totally Gifts experience voucher, you acknowledge that the experiences are dependent on certain factors beyond the control of Totally Gifts Ltd and agree that neither Totally Gifts Ltd nor any associated operator shall be liable for the cancellation, postponement or alteration of any experience for reasons beyond its reasonable control including for weather-related reasons, mechanical failure, location changes or otherwise.

We do not undertake any technical examination of equipment, facilities or services in order to minimise personal risk. If it occurs that mechanical machinery breaks down you should expect reasonable substitutions without notice.

The total liability of Totally Gifts Ltd for any claim whatsoever in connection with the Totally Gifts experience voucher or any experience shall be limited to the price paid for the experience voucher. We have tried to ensure that the descriptions and images used on all marketing material are accurate. However, images are intended to give a general idea of the experience described and do not form any contract between the purchaser and / or recipient and Totally Gifts Ltd.

Complaints
We welcome your valuable feedback on all of our experiences. If you have any problem or complaint your experience day, please inform to the supplier at the venue as soon as possible, so that they can investigate it further on an urgent basis. If your problem is not resolved on the day, please contact our Customer Service, including your voucher reference, participant and venue details, and we will be happy to take the matter up with the supplier.

Safety & Restrictions
These activities may involve some personal risk so you may be required to sign the disclaimer please read these carefully. Some personal insurance policies may not cover all our experiences you might require personal accident insurance. Please check with the operator well in advance of your day. We can arrange personal accident insurance on your behalf for an additional cost if requested. Note that operators usually require compliance to a certain type of conduct from participants.

Many of the gift experiences may have some types of restrictions these conditions may vary depending upon the suppliers. These restrictions may include height, age, weight, health restrictions.

Please read these carefully it is your responsibility to ensure that you buy the appropriate gift for your recipient or for yourself. It is the responsibility of the recipient to check if any of the above restrictions are applies to him. Under any circumstances we will not be held responsible for buying any unsuitable voucher for yourself or for your recipient. If you are not sure of suitability of any experience please contact us.

We reserve the right to refuse the participation in any of the experiences if you or your recipient has failed to inform us about the conditions that might make the participation dangerous for themselves or any other third party.

Validity & Voucher Redemption
All the vouchers are valid for 10 months from the date of purchase (unless otherwise stated on the voucher or on the website). The voucher expiry date will be mentioned clearly on the voucher if you cannot find it please contact our customer services or email us at vouchers@TotallyGifts.co.uk

The voucher will be deemed invalid if it has been expired and cannot be extended after the expiry date. The vouchers can be extended within the validity period only. If you want to redeem the voucher please contact our booking centre or vouchers@TotallyGifts.co.uk.

Cancellations
If you are not happy with your order and you have not booked your experience you have the right to return any vouchers within 30 days of purchase date a refund will be paid. All refunds will incur a £20 or 20% (whichever is greater) administration charges.

Once you or your recipient has booked an experience with supplier(s) you are bound by their Terms and Conditions. If the experience is booked with the supplier you cannot cancel re-schedule, postpone or cancel under any circumstances.

Sometimes we have to cancel an experience for reasons beyond our control, such as the weather, technical fault or mechanical breakdown. We will do our best to notify you as soon as possible and do everything we can to offer an alternative date / time. Unfortunately, in these circumstances, Totally Gifts will be unable to reimburse travel, accommodation or any other expenses you may incur as a result of experience cancellation.

Refunds
All refunds will be made to the person who purchased the voucher and the amount will be refunded back to the purchased credit / debit card. All refunds will be processed at the end of the every calendar month it may take up to 5-10 working days to show on the customers account.

In order to request a refund you MUST return your voucher / gift via recorded delivery to Totally Gifts Ltd, Customer Services, Lords Business Centre, Unit 7, 2nd Floor, 665 North Circular Road, London, NW2 7AX along with a covering note detailing the reason for your refund request.
Exchanges
All the vouchers can be exchanged only once, for any other experience available however there will not be any additional charges if you exchange your voucher within 14 days from the date of purchase. If you want to exchange the voucher after 14 days from the date of purchase then you or your recipient will have to pay administration charges of £20 plus the difference if exchanging with the higher value voucher. If you are exchanging for a lower value voucher your credit amount will be held into your account for maximum of 10 months from the date of original voucher was purchased and after this period your credit amount cannot be spend.

Once voucher is exchanged it becomes non-returnable, non refundable and non-exchangeable. To exchange the voucher please send your voucher via recorded delivery with a cover note detailing reason of exchange and payment.

New voucher will not be issued unless old voucher and full payment is sent to our address via  Totally Gifts Ltd, Customer Services, Lords Business Centre, Unit 7 2nd Floor, 665 North Circular Road, London, NW2 7AX with a recorded delivery.

Refunds
If you are not happy with the purchase for whatever reasons we will refund you within 14 days of delivery however the item(s) must be returned to us in which condition you received it. The postage charges will not be refunded if the item(s) is not defective and we have not made any error in processing your order.

Change of Mind
Products returned to us because you have changed your mind must be in perfect re-saleable condition, and must be returned to us within 14 days of delivery. We cannot accept a return if the item has been personalised and the order has been processed correctly. Please note that item(s) returned to us for reasons not due to our error or defective Product(s) will not have return postage/shipping costs refunded.

Defective Items
If you want to return an item because of an error on our part, or because it is defective, we will happily refund your costs in returning it to us. The item(s) must be returned in the condition in which you received it within 14 days of delivery.

Returns
If you want to return an item, simply email us at Support@TotallyGifts.co.uk indicating which item(s) and the number of items to be returned, please state reason for returning the item, and whether you are seeking a replacement or refund.

Returned Item(s) Lost in Transit
We cannot be held responsible for packages lost in transit: as you are responsible for returning the items to us, we recommend sending the packages by Recorded/Special Delivery.

Refunds and Replacements
For item(s) returned to us within 14 days of delivery in accordance with our terms and conditions, a refund or replacement will be processed by Totally Gifts Limited within 14 working days of receipt of the returned items.

A refund will be made in the same form of payment that was used to make the initial purchase. If you would like a Replacement, please mention that while returning your item(s) or email us at Support@TotallyGifts.co.uk

Delivery
Delivery is usually within 5-7 working days for Standard Delivery however for few personalised items it can take up to 10 working days (please check the product details page and shopping cart page) and for UK Express Delivery within 2-3 working days
If you do not receive your order within 28 days from the ordered date, Totally Gifts Ltd. does not take liability unless you notify Totally Gifts Ltd.  by email at Support@TotallyGifts.co.uk of the problem within 40 days from the order date.

Unless you have cancelled your order prior to delivery, you will become the owner of the Products once they have been delivered to you. Under any circumstances, after delivery they will be held at your own risk and Totally Gifts Ltd. will not be liable for any loss, damage or destruction to the Products except insofar as it arises from an inherent defect in any of the Products.

Liability
Unless otherwise agreed in writing, Totally Gifts Ltd. maximum liability to you arising by reason of or in connection with the supply of the Products to you shall be limited to the amount paid by you in respect of the Products in question (“Order Amount”). Totally Gifts Ltd shall not in any event be liable to you for:
(i) any direct loss in excess of the payment amount; or
(ii) any loss of profits, business or anticipated savings or loss of or corruption to data or any other indirect loss or consequential loss whatsoever even if it has been advised of the possibility of such loss.
Nothing in these conditions of sale shall exclude or limit the liability of Totally Gifts Ltd. for death or personal injury due to its negligence or for its fraud. This does not affect your statutory rights as a customer.
